Nestopar Privacy Policy

Effective Date: The date you create a Nestopar account and agree to this Privacy Policy.

1. Introduction

This Privacy Policy (“Policy”) describes how Nestopar Pvt. Ltd. (“Nestopar,” “we,” “our,” or “us”) collects, uses, shares, and protects your personal information when you use Nestopar Connect, Minix, Shop, Premium, Pro, Chat, Social posts, Voice-based features, and any other services, applications, APIs, or integrations offered by Nestopar (collectively, the “Platform”).
By using Nestopar, you consent to the processing of your personal data as described herein, subject to applicable laws including the Information Technology Act, 2000 (India), the Digital Personal Data Protection Act, 2023 (India), COPPA (where applicable), GDPR (where applicable), and other international regulations.
This Policy applies to all users globally, regardless of location. Where local laws impose stricter standards, we will comply with those requirements.
Your continued use of Nestopar after any updates to this Policy constitutes acceptance of the revised terms.

2. Information We Collect

a) Account & Profile Data: Name, email address, phone number, gender, date of birth, profile picture, and other identifiers provided during registration.
b) Content Data: Content you create, upload, or share, including videos, photos, captions, messages, comments, and metadata such as file creation dates and geotags.
c) Voice Data: Audio inputs through voice-based search or commands, processed for query recognition, personalization, and feature enhancement. Such data is encrypted during transmission.
d) Usage Data: Details of your activity on the Platform including content viewed, features used, interactions, time spent, frequency, and duration.
e) Device & Technical Data: Device type, OS, browser type, IP address, cookies, mobile carrier, app version, crash reports, and performance logs.
f) Transaction Data: Purchases, subscriptions, Pro discounts, payment details (card number, UPI ID, billing address), and delivery details.
g) Networks & Connections: Accounts, pages, and groups you follow; contacts you upload, sync, or import (address books, call/SMS history).
h) Sensitive Data: If voluntarily provided, we may process sensitive categories such as political or religious views, health data, or sexual orientation, subject to additional protections under law.
i) Third-Party Data: Information about you provided by other users (tags, mentions, messages) or partners (advertisers, merchants).

You are responsible for ensuring the accuracy of personal data provided to Nestopar.

3. How We Use Information

Provide, operate, and improve our services.
Personalize feeds, recommendations, and advertisements.
Facilitate transactions, process payments, and deliver purchases.
Enable and improve voice search and recognition features.
Detect, prevent, and address security incidents, fraud, and abuse.
Enforce our Terms of Service and Community Guidelines.
Conduct analytics, research, and development of new features.
Communicate with you regarding updates, promotions, and support.
Protect our users and comply with legal obligations.

4. Voice Search & Audio Data

Audio recordings are encrypted during collection and processing.
Recordings may be stored temporarily (up to 90 days) for training and system improvement, after which they are anonymized or deleted.
Voice data is never sold to advertisers or used for behavioral profiling of minors.
Users may access, manage, or delete their voice activity at any time via Settings.

5. Children’s Privacy

Minimum Age: Children under 13 (or higher minimum under local law) are prohibited from using Nestopar. Accounts found to violate this will be terminated.
Restricted Accounts for Minors (13–17):
- Default privacy settings are Friends-only.
- Location sharing is disabled by default.
- Direct targeting of ads to minors is prohibited.
- Sensitive data (voice, biometric, or location data) of minors will not be used for behavioral advertising.
- Certain features may be age-restricted or require parental consent.
Parental Rights: Parents/guardians may request review, correction, or deletion of a minor’s account data by contacting Nestopar Support.
Monitoring: We employ automated and manual systems to detect underage activity and enforce child protections.

6. Sharing Information

With Other Users: Profile information, posts, and interactions are shared based on your privacy settings.
With Advertisers (Strictly Limited & Consent-Based): Nestopar does not sell personal data. We may share limited identifiers — including name, mobile number, email, city of residence, and date of birth — strictly upon your explicit consent.
With Merchants/Partners: Information such as name, contact details, delivery address, and transaction details is shared with merchants to fulfill Shop or Pro purchases.
With Service Providers: We may share data with vendors performing services on our behalf, including hosting, cloud storage, payment processing, analytics, and customer support.
For Legal Reasons: We may disclose data to comply with applicable laws, lawful requests, or to protect Nestopar’s rights, property, or safety, or that of our users or the public.
With Affiliates: We may share information with other companies owned or controlled by Nestopar Pvt. Ltd., subject to this Policy.

7. Data Retention

Account data: retained while your account remains active.
Transactional data: retained for a minimum of 7 years to comply with tax and accounting laws.
Voice data: retained for no longer than 90 days unless anonymized for system training.
Backups and archives may persist for longer periods but are secured and restricted.

Users may request deletion of their data at any time, subject to legal and contractual requirements.

8. User Rights

Right of Access: Obtain confirmation and a copy of your personal data.
Right of Rectification: Request corrections to inaccurate or incomplete data.
Right of Erasure: Request deletion of your data, subject to legal requirements.
Right to Restrict Processing: Limit how we use your data in certain cases.
Right to Data Portability: Receive your data in a structured, machine-readable format.
Right to Object: Object to processing for direct marketing or other legitimate purposes.
Right to Withdraw Consent: Withdraw consent for optional processing (e.g., Infocash advertiser sharing).
Right to Lodge a Complaint: File a complaint with data protection authorities if you believe your rights are violated.

9. Security

Encryption of data in transit and at rest.
Firewalls, intrusion detection, and secure access controls.
Restricted access to personal data to authorized personnel only.
Employee training and confidentiality agreements.

However, no system is fully secure, and Nestopar cannot guarantee absolute protection. Users must safeguard their login credentials and devices.

10. International Transfers

Your data may be processed in countries other than your own, including India and other jurisdictions where Nestopar or its service providers operate. Where required by law, we implement safeguards such as Standard Contractual Clauses, adequacy decisions, or equivalent measures to ensure lawful transfers of personal data.

11. Governing Law & Jurisdiction

This Policy shall be governed by and construed under the laws of India.
All disputes arising from or relating to this Policy shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.

12. Updates

Nestopar may update this Privacy Policy from time to time.
Material changes will be communicated via app notifications, email, or website banners at least 7 days before taking effect.
Continued use of the Platform after changes constitutes acceptance of the revised Policy.
